the Indian Information Technology (Intermediaries guidelines) Rules, 2011 and
Rule 4 of the Information Technology (Reasonable security practices and
procedures and sensitive personal data or information) Rules, 2011 of
Information Technology Act, 2000 amended through Information Technology
Amendment Act, 2008 that require publishing the Terms of Services and practices
for access or usage of www.trimiya.com (“Website”) and Trimiya (“Application”)
which can be downloaded from the App Store.

crafted to ensure adherence to various legal and regulatory requirements,

1. Section 43A of the
Information Technology Act, 2000 (IT Act):
In accordance with Section 43A of the IT Act, we have implemented reasonable
security practices and procedures to safeguard your personal information
against unauthorized access, use, or disclosure. This section mandates that
organizations handling sensitive personal data adopt adequate measures to
protect such data from misuse and breach.
2. Rule 4 of the
Information Technology (Reasonable Security Practices and Procedures and
Sensitive Personal Information) Rules, 2011 (SPDI Rules):
Our practices align with Rule 4 of the SPDI Rules, which outlines the
requirements for handling sensitive personal data or information. We adhere to
the prescribed security measures to ensure that your sensitive personal
information, including financial data, health information, and any other

Information Technology (Intermediaries Guidelines and Digital Media Ethics

details, delivery address, and records related to consultations with medical

Personal Data: When you use our services, we may collect sensitive personal

health information, medical records, treatment plans, medication details,
diagnostic results, and any other related information. We may also collect
payment details such as card numbers, expiration dates, and billing addresses.
We
may also collect information required for providing the Services including,
items you place in the cart, pharmaceutical, nutraceutical products including
prescription drugs or over the counter (OTC) products you may order, height,
weight, lifestyle habits, diet habits and profile, delivery address, exercise
habits, facilitating booking a consultation with a Medical Practitioner, etc.
You can choose not to provide certain information, but then you may
consequently not be able to take advantage of many of our features or avail the
Services. We may also collect sensitive personal data or information (“SPDI”)
about you when you use the Services. This information includes health
information we receive from you or, on your behalf, such as information or
records relating to your medical or health history, health status and
laboratory testing results, details of medical practitioner issuing the
prescription, details of treatment plans and medication prescribed by a medical
practitioner, dosage details such as frequency of dosage, medicines or products
ordered by you through the Platform, diagnostic results, other health-related
information including nutritional deficiencies, and any other information
inferred therefrom. We may also collect payment information such as your
payment card number, expiration date, billing and shipping address. By using
the Service, you consent to the recording, storage, and disclosure of such
communications you send or receive for these purposes. We may also store and
process prescriptions, treatment notes, recommendations and other data
generated by medical practitioners on or through the Platform, and data shared
by third parties such as diagnostics related information; prescription related
information etc. and may retain such material for our records for the duration
of you availing the Services or for any such period required or permitted under
applicable law. Information you provide through our Services, including your
reviews, photographs, comments, lists, followers, the users you follow,
ordering details and history, favourite categories, special requests, contact
information of people you add to, or notify of, your orders through our
Services, names, and other information you provide on our Services, and other
information in your account profile.

User Contributions: Information you provide through our
services, including reviews, photographs, comments, favourites, and other
account details, may be posted on publicly accessible areas of our platform or shared
with third parties. While we strive to protect your information, we cannot
guarantee the security of User Contributions as they are displayed publicly and
may be accessed by unauthorized users.

Storage and Sharing: We may store and process prescriptions,
treatment notes, and other medical data for the duration of your use of our
services or as required by applicable laws. Your information may be shared with
businesses and distributed through third-party sites and services.
7.
Personal data i.e. Name, Mobile Number, Email Id and other
similar information; Detailed personal information, such as your date of birth,
marital status, title, gender, educational qualifications and background,
employment status, organization name, identification documents, health
conditions, and lifestyle information.
8.
App
data: We collect, transmit, and store information
pertaining to the installed application on our secured server.
9.
Tracking Information such as, but not limited to
the IP address of your device and Device ID when connected to the Internet.
This information may include the URL that you just came from (whether this URL
is on the Website or not), which URL you next go to (whether this URL is on the
Website or not), your computer or device browser information, and other
information associated with your interaction with the Application;

Financial
Data: This includes your financial information, bank account details, bank
account statements, tax residency details, tax status, declaration details,
income details, nominee details, and other financial information. We will
collect this data after obtaining necessary permissions from you, in accordance
with applicable law.

Financial
Information: This includes information as defined under the Master Direction -
Non-Banking Financial Company - Account Aggregator (Reserve Bank) Directions,
2016, as updated or amended from time to time.

collect from users who are not registered as members of this Application,
including, but not limited to, browsing behaviour, pages viewed etc. We also
collect and store personal information provided by You from time to time on the
Application. We only collect and use such information from you that we consider
necessary for achieving a seamless, efficient and safe experience, customized
to your needs including:

To communicate the necessary
account and service-related information from time to time;

interactions with our customer support team, responses to surveys, engagements
with members of the Trimiya Application, and from other accounts we reasonably
believe you control, either partially or wholly.
We might receive information about you such as order
details, your details shared with our partners etc. from other sources
including from our partners, advertisers or third parties registered on the
Platform and add it to our account information.
14. Additionally, for quality assurance, training
purposes, or its own protection, the Trimiya Application may monitor or record
its telephone conversations with you or any individual acting on your behalf.
By communicating with Trimiya, you acknowledge that your communication may be
overheard, monitored, or recorded without further notice or warning, except as
otherwise required by applicable law.
15. To help protect you from fraud and the misuse of
your personal information, we may collect information about you and your
interactions with the Trimiya Application. Additionally, we may evaluate your
computer, mobile phone, or other access devices to identify any malicious
software or activity.
16. When you download or use our mobile applications
or access one of our mobile-optimized sites, we may receive information about
your location and your mobile device, including a unique identifier for your
device. We may use this information to provide you with location-based
services, search results, and other personalized content.
17. Automatic Information: We receive and
store certain types of information whenever you interact with us. For example,
we obtain certain types of information when your web browser accesses the Site
or advertisements and other content served by or on behalf of Site on other web
sites. (OS type and version, App version, device brand, browser and its version
details, user agent) to see examples of the information we receive. We may also
receive/store information about your location and your mobile device, including
a unique identifier for your device. We may use this information for internal
analysis and to provide you with location-based services, such as advertising,
search results, and other personalized content. Unique mobile device identifier
(e.g. IDFA, GAID or other device IDs on Apple devices like the iPhone and
iPad), if you're using our Services on a mobile device, we may use mobile
device IDs (the unique identifier assigned to a device by the manufacturer),
instead of cookies, to recognize you. We may do this to store your preferences
and track your use of our applications. Unlike cookies, mobile device IDs

choose to not provide us with personal information or SPDI or if you ask us to
delete your personal information or account, we may no longer be able to
provide all or any of our Services to you., but in the event that you do so, we
will be unable to provide you access to the Platform or provide Services
Where any service
requested by You involves a third party, such information as is reasonably
necessary by the Application to carry out Your service request may be shared
with such third party. We also do use your contact information to send you
offers based on your interests and prior activity and also to view the content
preferred by you. The Trimiya Application may also use contact information
internally to direct its efforts for service improvement but shall immediately
delete all such information upon withdrawal of your consent for the same when
you ‘delete your account’ or through
an email to be sent to contact@trimiya.com.
To the extent
possible, we provide You with the option of not divulging any specific
information that you wish for us not to collect, store or use. You may also
choose not to use a particular service or feature on the Application and opt-out
of any non-essential communications from the Application.
Further, transacting
over the internet has inherent risks which can only be avoided by you following
security practices yourself, such as not revealing account/login related
information to any other person and informing our customer care team about any
suspicious activity or where your account has/may have been compromised.
Cookies and Other
Tracking Technologies:
We utilize “cookies”
and other tracking technologies. A “cookie” is a small text file that may be
used, for example, to collect information about activity on the Platform. Some
cookies and other technologies may serve to recall information previously
indicated or submitted by you. Most browsers/mobile settings allow you to

them. You may set most browsers/mobile application to notify you if you receive
a cookie, or you may choose to block cookies with your browser/mobile

(including building upon our network of our consulting medical practitioners,
partners etc);

We use the information that you provide for such purposes such as
responding to your requests, customizing your orders, improving our Platform or
communicating with you

For non-targeting reasons such as frequency capping, compliance, billing,
ad reporting or delivery, market research or product development purposes; To
comply with applicable law;
10. To conduct audits and quality assessment

11. To analyze the use of our resources,
troubleshooting problems and improving our products and Services, by using the

our application so that we can improve it and cater personalized content/ads

de-identified information, of which your personal or sensitive personal
information might be a component, for any business or other purpose not
prohibited by applicable law, including for research and marketing purposes

Platform, you accept the terms hereof and hereby consent to the storage and
processing of the personal information and SPDI by third parties. We may

notifications to your mobile device on our behalf, provide voice recognition

our Services, process and collect payments, help us diversify the payment
processing and collection methods available, providing consultation and
diagnosis, and offer you special offers and services where available. Some of
our products, Services and databases are hosted by third party hosting services
providers. We also may use vendors for other projects, such as conducting

your diagnostic test reports for providing and improving the Services,
marketing and promotional efforts, customize your experience and aiding you in
procuring targeted consultation for the underlying medical condition. These
uses improve the Platform, and the Services, and better tailor it to meet your
needs, so as to provide you with an efficient, safe and customized experience.
We may transfer such personal Information and SPDI to a third party, including
persons outside India, to improve product and Service offerings while taking
commercially reasonable steps to try and ensure, that the recipient adheres to
the applicable laws for ensuring data protection as is adhered by us.

Social Networks. If
you interact with social media features on our Services, such as the Facebook
Like button, or use your social media credentials to log-in or post content,
these features may collect information about your use of the Services, as well
as post information about your activities on the social media service. Your
interactions with social media companies are governed by their privacy
policies.

availing the Services, you accept the terms hereof and hereby consent to us,
sharing with and/or processing of your personal information and SPDI by third
parties, including in any location outside India, provided that they ensure
that your SPDI is protected in compliance with standards that are comparable to
the standards of protection afforded to it in India or equivalent international
standards.
Information Security
We maintain electronic, physical and procedural safeguards in connection with
the collection, storage and disclosure of personal information (including
SPDI). We endeavor to protect the security of your information during
transmission by using Secure Sockets Layer (SSL) software, which encrypts
information you input in addition to maintaining security of your information
as per the industry standards. We restrict access to personal information, to
our employees and agents who need to know that information in order to process
it for us, and who are subject to strict contractual confidentiality
obligations, and may be disciplined or whose relationship with us may terminate
if they fail to meet these obligations. No employee or administrator will have
knowledge of your password of your account on the Platform. It is important for
you to protect Your account against unauthorized access to your password and
your mobile phone. You must be sure to log off from the Platform when you have
finished use thereof. We do not undertake any liability for any unauthorized
use of your account and password. If you suspect any unauthorized use of your
account, you must immediately notify us by sending an email to the contact
details indicated in the contact section. You shall be liable to indemnify us
due to any loss suffered by Us due to such unauthorized use of your account or
password.
However, we shall
not be responsible for any breach of security or for any actions of any third
parties or events that are beyond our control including but not limited to acts
of government, computer hacking, unauthorized access to computer data and
storage device, computer crashes, breach of security and encryption, poor
quality of internet service or telephone service of the user, etc. We implement
appropriate security measures to protect your personal Information from unauthorized

Retention of

store your personal information for our business purposes, whether such
personal information has been deleted or not. After a period of time, your

You expressly consent
to Trimiya (including its marketing channels and business partners) to provide
the details, documents, and information mentioned under ‘Information Collected’

By providing your
details and documents through the Application, including but not limited to
personal information and other information as mentioned hereinabove, you
expressly consent to Trimiya (including its marketing channels and business
partners) contacting you via SMS, call, and/or email, and to follow-up calls
related to the services provided by Trimiya through the Application. This
includes imparting product knowledge, offering promotional offers available on
the Platform, and various other offers provided by its business partners.
You authorize and
expressly consent to our sharing of your personal information (only to the
extent required) with third parties for the purpose of providing services under
the Trimiya Application, such as your mobile number for OTP delivery, and to
retrieve bank accounts and other financial information as may be necessary to
provide the services offered by Trimiya.

collected. If the same is not identified to you, you have the right to request
the Application to elucidate the purpose of collection of said personal

loss or damage which may be incurred by you as a result of the availability of

placed by you on the completeness, accuracy or existence of any advertising, services
or other materials on, or available from, such applications and websites. These

accessible in the public domain or is furnished under the Right to Information

AND CHANGING YOUR PROFILE
Following
registration, you can review and change the information you submitted at the
stage of registration, except Email ID and mobile number. An option for
facilitating such change shall be present on the Application and such change
shall be facilitated by the User. If you change any information, we may or may
not keep track of your old information. We will not retain in our files
information you have requested to remove for certain circumstances, such as to
resolve disputes, troubleshoot problems and enforce our terms and conditions.
Such prior information shall be completely removed from our databases,
including stored ‘back up’ systems. If you believe that any information, we are
holding on you is incorrect or incomplete, or to remove your profile so that
others cannot view it, the User needs to remediate, and promptly correct any
such incorrect information.
CONTROL OF YOUR PASSWORD
You are entirely responsible for maintaining the
confidentiality of your password. You must protect it against unauthorized
access of your account and information by choosing your password carefully and
keeping your password and computer secure by signing out after using our
services.
You agree not to use the account, username,
email address or password of another Member at any time or to disclose your
password to any third party. You are responsible for all actions taken with
your login information and password. If you lose control of your password, you
may lose substantial control over your personally identifiable information and
may be subject to legally binding actions taken on your behalf. Therefore, if
your password has been compromised for any reason, you should immediately
change your password. You agree to notify us immediately if you suspect any
consistent unauthorized use of your account or access to your password even

outside the Application. We follow generally accepted industry standards to
protect the Personal Information submitted to us and information that we have
